IYC: COURT SERVES "FORM 49", ASK OFFENDERS TO DEFEND THEMSELVES.

YENAGOA: In a recent Judgement dated September 21st 2016, a High court holden in Yenagoa with suit no: YHC/79/2015 has served a notice to the below mentioned Persons to show cause why order of committal should not be made, the served persons are; Chief Preye Agama, Mr. Owoupele Jeremiah, Mr. Saviour Olali, Barr. Ekine Egbelekuro, Mr. Elvis Donkemezuo, Mr. Bristol Emmanuel, Mr. Alfred Kemepado, Mr. Mike Edonkumor, Mr. Sunny Ogori, Mr. Wisdom Oniekpar Ikuli and Mrs. Felicia Reginald Ngeri respectively.

The court had earlier given a judgement maintaining that the tenure of the current IYC Executives is for three (3) years and one term and ordered the aforementioned persons to obey the order of the judgement contained in the ruling that was given on 20th day of November 2015 at same court, Presided over by Hon. Justice E. Ogola or be committed to Prison for contempt of court.

The court has therefore decided to take this stand following evidences of disobedience to the Judgement earlier given. The court stated that their committal is sequel to continue disobedience of court ruling given on 20th day of November, despite notice of "form 48" that was served to them.

The court maintained that the aforementioned persons are to attend court to defend themselves on a date that will be set out.

The Judgement on 20th November reads as follows:

•That by the combined effect of and the provisions of the preamble and article 8 of the Ijaw Youth Council Worldwide Constitution (as amended), the tenure of the office of the national executives of the IJaw Youth Council is for three(3) years of one (1) term, which said tenure shall start counting from the date of inauguration.

•That the tenure of the office of the claimants and /or all the members of the current National Executives of the Ijaw Youth Council duly represented by the claimants, have not yet expired, they have been inaugurated and/or sworn in on 2nd day of March, 2014.

•That the tenure of the office of the claimants and/ or all the members of the current National Executives of the Ijaw Youth Council duly represented by the claimants, will expire on the 1st day of March, 2017, they haven been inaugurated and/or sworn in on the 2nd day of March, 2014.

•That the attempt by the Defendants and/ or the Defendant's supporters, surrogates, cronies and acolytes to hold a congress, meeting and /or election for the formation or election of new members of the National Executives of the Ijaw Youth Council, is illegal, unconstitutional, null and void, in the tenure of the Claimants and/or all the members of the current National Executives of the Ijaw Youth Council has not yet expired.

•That the Defendants and /or the Defendant's supporters, surrogates, cronies and acolytes are hereby restrained from holding a congress, meeting and /or election for the formation or election of new members of the National Executives of the Ijaw Youth Council until after the expiration of their tenure "1st day of March 2017".
